These starter terms explain that QuoteBuilder Pro provides software, not field services, and that calculator outputs are planning estimates rather than binding quotes.

1. Acceptance of these terms

These Terms of Service are sample MVP terms for QuoteBuilder Pro. By accessing or using the service, you agree to these terms. If you do not agree, do not use the service.

These terms are not a substitute for advice from a licensed attorney. Before selling QuoteBuilder Pro commercially, have counsel review these terms for your business model, state, customers, and risk profile.

2. What QuoteBuilder Pro provides

QuoteBuilder Pro provides software that lets businesses create quote calculators, publish quote pages, embed calculators on websites, collect submissions, and manage leads.

QuoteBuilder Pro does not provide construction, remodeling, rental, disposal, consulting, or other field services. The business using the calculator is solely responsible for its services, pricing, customer communication, and customer agreements.

3. Estimates are non-binding

This estimate is for planning purposes only and is not a binding quote, offer, contract, or guarantee. Final pricing may vary after the service provider reviews project scope, site conditions, materials, labor, disposal fees, permits, availability, and other business-specific factors.

A calculator result does not create an obligation for the visitor to purchase services or for the service provider to honor the displayed estimate. Any final quote, invoice, contract, schedule, or job scope must be agreed directly between the visitor and the service provider.

4. Customer responsibilities

Businesses using QuoteBuilder Pro are responsible for configuring calculator questions, pricing rules, disclaimers, follow-up processes, and customer communications accurately.

Businesses are responsible for complying with laws, licensing requirements, consumer protection rules, privacy obligations, and industry-specific requirements that apply to their services and customers.

5. Leads and submitted information

Visitors may submit contact details, project notes, calculator answers, and estimated price information. Businesses may use that information to follow up about potential services.

Businesses should collect only the information they need, keep it only as long as necessary, and handle it responsibly.

6. Availability, maintenance, and changes

QuoteBuilder Pro is provided using commercially reasonable efforts, but we do not guarantee uninterrupted access, error-free operation, permanent availability, or permanent data retention.

We may change, suspend, or discontinue features or the service with reasonable notice when practical. Early customers should treat the product as an MVP or beta unless a separate written agreement says otherwise.

7. Cancellation and discontinuation

Unless a separate written agreement says otherwise, either party may cancel service at any time. After cancellation, access may be disabled and data may be deleted after a reasonable export or transition period.

If QuoteBuilder Pro is discontinued, we will use reasonable efforts to notify active customers and provide a reasonable opportunity to export available lead data.

8. Limitation of liability

To the maximum extent allowed by law, QuoteBuilder Pro is not liable for lost profits, lost business, lost data, inaccurate estimates, service provider disputes, customer disputes, indirect damages, incidental damages, consequential damages, or damages caused by third-party services.

QuoteBuilder Pro is not responsible for promises, estimates, contracts, workmanship, delivery, scheduling, billing, refunds, or customer service provided by businesses that use the platform.
